Hearings Office updates trademark procedure guidelines


The New Zealand Intellectual Property Office (IPONZ) updated several Hearings Office guidelines on 4 September 2026. The revised deadline procedure took effect on 7 September 2026.

For trademark cases determined only by written submissions and/or on the papers, deadlines are now set once the pre-hearing directions have concluded, rather than after a hearing date is allocated. Usually, the initiating party has one month to file its written submissions and bundle of authorities and pay the hearing fee; the responding party then has one month from that filing date. This allows cases to be referred to an Assistant Commissioner at short notice. Where at least one party attends the hearing, deadlines remain linked to the hearing date.

The guidelines also introduce a model confidentiality undertaking and clarify the evidence procedure in trademark revocation proceedings.
