Changing landscape for trademark renewals

The Libyan Trademark Office has lately restricted practice before the Registry to a specific list of authorized agents. As a result, many brand owners must now appoint new local counsel before their renewal applications can proceed.

While this is an administrative adjustment rather than a formal change in the law, its practical impact is significant. Changing a representative requires preparing a new Power of Attorney and completing strict legalisation formalities—a time-consuming process, particularly for multinationals managing extensive portfolios. Leaving these steps until the renewal deadline approaches can lead to costly, unnecessary delays.

This development highlights a broader reality across the MENA region: administrative practices frequently shift even when legislation remains the same. Trade mark maintenance sometimes involves more than simply paying official fees before an expiration date.

To prevent last-minute complications and ensure their valuable rights remain protected, brand owners should review their Libyan portfolios to verify that their appointed counsel is fully authorised.
