New, modernized Trademark Law


After more than a quarter of a century without substantial changes, the Cuban government has approved important new legislation on trademarks, moving the country closer to international standards such as the Paris Convention, TRIPS principles, and Madrid System-style concepts.

The measure was announced on June 9, 2026 with publication in the Official Gazette, and officially came into force on August 8, 2026, replacing Decree-Law 203 that has been in effect since December 1999.

One of the most significant changes is that the new framework expands the types of trademarks that can be registered in Cuba; now signs including sounds, three-dimensional shapes, colors, and other non-traditional trademarks can be protected.
