New trademark opposition procedure


Argentina’s Patent and Trademark Office (INPI) has introduced a new procedure for the administrative resolution of trademark oppositions under Resolution No. 297/2026. The new Regulation entered into force with its publication in the Trademark Bulletin on August 12, 2026.

The procedure applies to oppositions against trademark applications filed on or after March 1, 2026. Applications filed on or before February 28, 2026 remain subject to the previous rules.

Key changes include shorter and more concentrated procedural stages. Opponents have 15 business days to confirm that they maintain an opposition, pay the required fee, supplement their grounds and submit evidence. Applicants likewise have 15 business days to request an INPI decision on unresolved oppositions, pay the applicable fee, respond and submit evidence.

Evidence must generally be submitted together with the respective filing rather than during a separate evidence stage. Before INPI issues its decision, both parties may voluntarily submit final arguments within a common 10-business-day period.

The changes make close monitoring of deadlines and early preparation of arguments and evidence particularly important.
