New trademark regulation streamlines procedures and strengthens formal requirements


Indonesia’s Ministry of Law has introduced Regulation No. 5 of 2026, which entered into force on 23 February 2026. The new regulation updates the trademark framework by codifying previous administrative practice, accelerating procedures and introducing greater legal certainty in several areas.

A key change is the shortened examination timeline. Trademark applications may now proceed to examination within 30 days where no opposition is filed, or within 90 days if an opposition is received. The regulation also significantly speeds up administrative procedures, including recordal of assignments and renewals, and confirms the issuance of electronic registration certificates.

At the same time, the new rules impose stricter documentation requirements, particularly regarding applicant identity and priority claims. The regulation further addresses matters previously not expressly governed, including changes of name or address, force majeure and collective marks for SMEs.

Overall, the reform points to a faster, more structured and more predictable trademark system in Indonesia.
