New Industrial Property Code approved


Cape Verde has adopted a new Industrial Property Code under Legislative Decree No. 2/2025 of 2 December, replacing the 2007 framework and modernising the country’s IP regime in line with international and regional commitments. The new Code introduces key changes including closer alignment of the patent system with international filing mechanisms, protection for unregistered industrial designs, and, for the first time, recognition of plant varieties and traditional knowledge.

The reform also simplifies trade mark registration by removing the requirement for graphical representation, strengthens trade secret protection, and promotes digitalisation through electronic filing and other administrative simplification measures. The new Code will enter into force on 2 June 2026.
