Major updates to Trade Mark Law introduced


On 6 March 2026, Bulgaria enacted amendments to the Trade Marks and Geographical Indications Act, modernising national trade mark practice and aligning it more closely with recent EU developments. The reform broadens the types of signs that may qualify as trade marks, gives the Bulgarian Patent Office authority to assess bad faith directly in opposition and cancellation proceedings, and introduces clearer rules for filing and procedure, including email submissions.

The amendments also significantly strengthen enforcement. They expressly treat the shipment of counterfeit goods by post, courier or transport operator as trade mark use requiring the owner’s consent, clarify that non-exhausted parallel imports may constitute infringement, and give the Bulgarian Patent Office new powers to act against infringing online content through takedown, blocking and domain-related measures. Overall, the reform is expected to speed up dispute resolution, improve digital enforcement, and enhance brand protection in Bulgaria.
