First comprehensive Trademark Law enacted


On 11 November 2025, the Maldives enacted its first comprehensive Trademark Act (Law No. 19/2025), establishing a modern statutory framework for trademark protection. The Act will enter into force on 11 November 2026 and will replace the long-standing system of cautionary notices with a formal registration regime aligned with international standards.

The new law introduces examination on absolute and relative grounds, opposition procedures, ten-year registration terms, and civil, criminal, and border enforcement measures against infringement and counterfeiting. It will operate alongside the Maldives Intellectual Property Office Act 2025, which takes effect on 1 January 2026.

Although implementing regulations are still pending, trademark owners are advised to maintain existing cautionary notices until the new system becomes operational, as these may serve as evidence of prior use during registration or disputes.
