Official fees updated

The Brazilian Patent and Trademark Office (BPTO) has published a new schedule of official fees covering services related to patents, trademarks, industrial designs, software, and contracts. The updated table, published in Official Gazette No. 2836 on May 13, 2025, will take effect on August 7, 2025.

This update reflects recent operational and technological improvements. Despite an average increase of 24.1%, the new fees remain below cumulative inflation since 2012, when the last adjustment took place, and are in line with those of other Latin American patent offices.

Microenterprises, individual micro-entrepreneurs (MEIs), small businesses, innovation-focused startups, scientific and technological institutions (ICTs), and nonprofits will continue to benefit from discounts of up to 60%.

The issuance fees for patents and trademarks have also been eliminated.

The new fee schedule takes effect on August 7, 2025, except for certain services that require further operational adjustments and for which specific timelines have been established.

By streamlining and clarifying its processes while keeping fees accessible, the BPTO fosters a more supportive environment for R&D and innovation in Brazil.

Here are some examples of the fee changes:

- Filing a trademark application: BRL 880;
- Maintenance fee for registered trademark – per class: BRL 1,000 (6% decrease);
- Issuance fee: free

The new fee schedule can be found on the BPTO's website here.
