European Community Trademarks

According to the Decree (EC) No. 40/94 of the Council of December 20th, 1993, European Community Trademarks were introduced on April 1st, 1996, in addition to the national and international registration. With a registration at the Office for Harmonisation in the Internal Market (OHIM) (trademarks, patterns, and designs) in Alicante (Spain), the trademark will be protected in all member countries of the European Union. A prior application or registration in the home country of the applicant is not required. In addition, the home country of the applicant does not have to be a member of the European Union either. Owners of national trademarks in the member states of the European Union may file opposition against a trademark applied for as Community Trademark. Therefore, it is recommended to conduct a search in each member country before applying for a European Community Trademark.

Madrid Agreement and Madrid Protocol

The Madrid System for the International Registration of Marks was established to simplify the filing, registration and maintenance of trade mark rights in more than one jurisdiction. A single trademark registration should automatically apply around the world, thus making international trademark registration more effective. The system for international registration of marks is governed by two treaties: the Madrid Agreement Concerning the International Registration of Marks, originally dating from 1891, and the Protocol Relating to the Madrid Agreement, that was adopted in 1989. The system is administered by the International Bureau of World Intellectual Property Organisation (WIPO), located in Geneva, Switzerland, which maintains the International Register and publishes the “WIPO Gazette of International Marks.”
