Legal basis is the Trademark Act of 2009 and Trademark Rules 1963.
Trademark protection is obtained by registration.
Nice classification
Registrable as a trademark are all distinctive and graphically representable signs, such as words, names, acronyms, letters, numbers, devices and any combination thereof.
The following trademark types are registrable: trade marks, collective marks and certification marks.
The application is filed at the Patent Office.
A separate application has to be filed for each class. Foreign applicants do not need a local agent. A postal address within Bangladesh is sufficient.
A non-legalised power of attorney is sufficient.
Foreign applicants need a domestic registration.
The application process includes a formal examination, an examination of distinctiveness and a search for prior trademarks. Signs not deemed distinctive in the examination can be registered if distinctiveness has been acquired by use.
The processing time from first filing to registration of a trademark is about 6 years.
Before registration every trademark application accepted by the Registrar will be published in the “Trademarks Journal”.
National:
The opposition period is 2 months from publication date of the application in the “Trademark Journal”.
Opposition against designation of IR Mark
(The period starts from the national publication date, if not stated differently):
not a member of the Madrid Agreement or Protocol.
A trademark registration is valid for 7 years.
The registration is renewable for periods of 10 years.
If the trademark has not been used within 5 years from the registration, it may be subject to cancellation.
The fee for trademark application in one class is approx. EUR 80.00 plus EUR 80.00 as publication fee and further EUR 200.00 as registration fee.
