Official Fees Increased
The Trademark and Patent Office of Andorra (OMPA) has announced a 7 percent increase in the official fees for all IP matters, effective in March 2017. This affects new applications only. Pending matters remain under the old prices before the increase.

The new official fees for filing a trademark application are now EUR 165,81 for up to three classes and EUR 25.58 for each additional class.

Legal basis is the Trademark Act of May 11, 1995 and the Regulations for the performance of the Trademark Law and of the Taxation Law of the Office of Trademarks, dated December 28, 1995.
Trademark protection is obtained by registration.
Nice classification, 11th edition
Registrable as a trademark are all distinctive and graphically representable signs. Also registrable is the three-dimensional shape of a good and the pantone of a colour. Not registrable are sound marks nor smell marks.
The following trademark types are registrable: trade marks, service marks and collective marks.
The application is filed at the Trademark Office (OMPA).
Applications can only be filed via an electronic device (USB).
Multiple-class applications are possible.
Foreign applicants need a local agent.
A non-legalised power of attorney is sufficient.
Applicants do not need a domestic registration.
The application process includes a formal examination and an examination of distinctiveness.
Afterwards, a certificate is issued and the registration is published electronically.
Every 3 months, the OMPA publishes the “Gaseta” (CD-ROM).
National:
There are no provisions for filing opposition against a trademark registration. All problems between trademarks must be solved amicably, or at the Court.
A trademark registration is valid for 10 years from the date of application.
The registration is renewable for periods of 10 years.
