IP recordals simplified


Argentina’s National Institute of Industrial Property (INPI) has issued Resolution No. 162/2026, introducing a new framework for recording ownership transfers and name or company name changes for trademarks, patents, utility models, and industrial designs.

The regulation aims to simplify and modernize recordal procedures. A key change is that foreign supporting documents for assignments and name changes will no longer require apostille or consular legalization. The INPI also clarifies that recordals are declaratory in nature, taking effect retroactively from the filing date of the request.

The new rules provide clearer guidance on required documentation, allow either the assignor or assignee to request recordal independently, and address specific cases involving inheritance, divorce, trusts, and corporate structures.

Resolution No. 162/2026 also sets out a more detailed process for office actions and objections, while confirming that rejected requests may be refiled once deficiencies have been corrected.
