IR Opposition Periods


The owner of an International Registration (so-called IR mark) is allowed to extend the request for protection to one single or all member states of the Madrid System without further national applications. This process is known as “designation”.

The list below contains the periods of opposition against such designation of internationally registered trademarks (IR) to the respective country. “Opposition period” indicates the deadline for filing an opposition against an International Registration at the national trade mark office. If not stated differently, the opposition period starts from the national publication date.

TC Turks and Caicos Islands N N Turks and Caicos are a British Overseas Territory with its own trademark law. CTMs and IR designating the UK cannot be re-registered in TC.
TK Tokelau N N Tokelau is a dependant territory of New Zealand. As such, it is not a member of the Madrid Agreement or Protocol.
KG Kyrgyzstan N Y There is no opposition, consequently no opposition period for Kyrgyzstan.
DZ Algeria N Y There is no opposition period, because Algeria do not adopt the opposition system.
KZ Kazakhstan N Y There is no opposition and, consequently, no opposition period for IR trademarks in Kazakhstan. However, anyone can proceed with cancellation against IR trademark within five years from the registration date (publication in WIPO Gazette) if there is any registered confusingly similar trademark.
TM Turkmenistan N Y The opposition period starts from the date of the publication in the WIPO Gazette. An opposition is possible at any time before issuance of the final decision by the Trade Marks Office/Registry.
PL Poland Y Y The opposition period is 6 months from the publication date of the registration in the ‘Wiadomości Urzędu Patentowego’.
CN China N Y The opposition period is 3 months, beginning from the first day of the month after the publication of the WIPO Gazette.
GR Greece Y Y The opposition period is 3 months from the date of the electronic national publication, by virtue of which the national part of the IR is approved
SI Slovenia Y Y The opposition period is 3 months from publication of the registration or subsequent designation to Slovenia in the WIPO Gazette.
FO Faroer Islands N N The Faroe Islands are not a part of the European Union. Accordingly, CTMs are not valid in FO. The Faroe Islands were not included when Denmark adhered to the Madrid Protocol in 1996. IR designating Denmark accordingly do not cover FO.
CK Cook Islands N N The Cook Islands is a self-governing state in free association with New Zealand. The current New Zealand trade mark legislation does not extend to the Cook Islands. The Cook Islands is not a member of the Madrid Agreement or Protocol.
RU Russian Federation N Y The opposition procedure is the same as for national marks, namely the opposition against pending IR mark may be filed only as an informing letter to the Examiner containing the arguments against the trademark registration which may be taken into account to the discretion of the Examiner.
VI United States Virgin Islands N Y See US (30 days). IR designating US automatically covers United States Virgin Islands. No further action required.
UM United States Minor Outlying Islands N Y See US (30 days). IR designating US automatically covers United States Minor Outlying Islands. No further action required.
MP Northern Marianas N Y See US (30 days). IR designating US automatically covers Northern Marianas. No further action required.
GU Guam N Y See US (30 days). IR designating US automatically covers Guam. No further action required.
PR Puerto Rico N Y See US (30 days). IR designating the United States automatically covers Puerto Rico.

IM Isle of Man Y Y see UK (2 months minus 1 day). UK Although the Isle of Man is not part of the European Union, CTMs are recognised and protected without re-registration. UK membership of the Madrid Protocol extends to the Isle of Man.
JE Jersey Y Y see UK (2 months minus 1 day) for IR designating the UK to JE. New trademark legislation was introduced in October 2000 to extend protection to CTMs (without re-registration) and IR. Amendments to the Community Trademarks regulations in 2004 now allow for CTMs applications from Jersey to be accepted by OHIM.
FK Falkland Islands Y Y see UK (2 months minus 1 day) against IR designating UK. Extension of a CTM is automatic in the Falkland Islands if the mark is also registered in the UK. This protection is based on national law and not on European Union law.
SJ Svalbard and Jan Mayen N Y see Norway (3 months). IR designating NO automatically cover SJ, no further action required.
PF French Polynesia N Y see France (2 months from publication of WIPO Gazette). IR trademarks designating France automatically do cover PF. CTMs are not valid in French Polynesia.

There is no opposition period.

AQ Antarctica N N Antarctica has no government, although various countries claim sovereignty in certain regions. While a few of these countries have mutually recognised each other's claims, the validity of these claims is generally not recognised universally. There are no native inhabitants.
AI Anguilla N N Anguilla is a British Overseas Territory with its own trademark law. CTMs and IR designating the UK cannot be re-registered in Anguilla.
MX Mexico N Y According with Section 3 of the Madrid Protocol, in regard with Section 6 septies of Paris Convention, the Opposition right is granted to the Trademark holders, but as long that the Law does not for see the proceeding of it there is no local legislation that regulates opposition. There is only the option to expunge a trademark registration from the registry, based on any of the causes of cancellation established by the Industrial Property Law (non-use cancellation action / nullity actions).

It is a formalities requirement for the opponent to notify the trademark applicant of its intention to apply for an extension of time and to request the latter’s consent. The total extension of time for which the Registrar may allow to file the notice of opposition cannot exceed 4 months from the date of the publication.
